Terms and Conditions

Welcome to World Jewellery. These Terms and Conditions govern your use of the website [worldjewellery.ca], including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”). Please read these Terms and Conditions carefully. By accessing or using the Site, you hereby acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.

1. Use of Site

You may use the Site for lawful purposes and in accordance with these Terms and Conditions. You agree not to use the Site:

  • In any way that violates applicable federal, provincial, or local laws or regulations.
  • To transmit, store, or distribute any material that is unlawful, defamatory, obscene, harmful, or infringing of any third party’s rights.
 2. Intellectual Property

All content on the Site, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of World Jewellery or its content suppliers and is protected by Canadian and international copyright laws.

You agree not to infringe on these laws and/or our Intellectual Property in any way, including attempting to copy or reverse-engineer any information, content, or source code, in part or in whole.

3. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

4. Product Information and Pricing

We make every effort to ensure the accuracy of information and pricing on our Site. However, we do not warrant that product descriptions, pricing, or other content on the Site are accurate, complete, reliable, current, or error-free. Some items may appear larger or smaller on the Site, than their actual size. Furthermore, items received may vary slightly from the image and specifications on the Site due to the manufacturing process and potential utilization of different suppliers, amongst other factors. Prices and availability of products are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions, and to revise or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice; including after you have submitted your order. If you have any questions or concerns about any items, please feel free to contact us and we will be happy to provide some guidance and clarification.

Colours

While we make an effort to display colours and products accurately, we cannot guarantee that your computer monitor’s display of colour will be accurate. Moreover, some images are renderings, and may therefore not accurately reflect the finished item received.

Pricing Fluctuations

We frequently adjust our regular prices according to important market variables, including: labour costs, metal prices, currency exchange rates – particularly Canadian dollars to US dollars, and other factors. Therefore, you can expect to see frequent fluctuations in our pricing on any given day. If market prices move in your favour, for example, lower metal prices and a stronger Canadian dollar, we make an effort to pass those savings onto you; conversely, when market prices move in the opposite direction, we typically increase our prices. This applies to most of the products found on our Site. We get that most companies do not operate in this fashion, but we genuinely believe this is the fairest approach to pricing for our clients.

Price Match Guarantees with Competitors

While we stand behind our great prices and the value we offer our clients, due to the fact that there are numerous variables when comparing jewellery, we will be unable to offer a price match with our competitors. For example, we share many details and are very transparent about the weight and dimensions of our precious metals jewellery, whereas most of our competitors are not as forthcoming. Some common items such as gold wedding bands may look the same; however, due to differing manufacturing processes, one wedding band can be made with a lot more gold than the other. Other important factors include the design and engineering of your jewellery, the workmanship, and the quality of materials utilized, including gemstones (no two gemstones are alike!). All this to say that it is next to impossible to find an identical piece of jewellery. It is definitely not like branded electronics with a model number that can easily be identified and compared.
 

Price Adjustments

We understand how frustrating it can be when you just purchased an item one day, and the price of that item drops the very next day! While we cannot make any price adjustments on market fluctuations impacting our regular prices, we may be able to make pricing adjustments for our clients under the following circumstances:

If within seven (7) days of your purchase you bring to our attention a price drop related to an active ongoing sale, while the sale is still in effect, where the promotion lasts six (6) days or greater, we would be happy to make a pricing adjustment for you by either adjusting the price (if payment has not yet been submitted or processed), or by issuing you a refund for the difference, at our sole discretion.

For example, if you purchased something from us yesterday and a six (6) day sales event has begun today, and you contact us tomorrow (sale still in progress) in order to bring this price drop to our attention. We will then assess the qualification of your price adjustment, including whether the current sale runs for six (6) days or longer before making a decision on approving your price adjustment.

Exceptions include: clearance, special order items and ‘special buys’, flash sales, weekend sales events and other short-term promotions that last less than six (6) days, including promotions communicated exclusively to our email lists and social media followers. We will not be able to offer any price adjustments under these circumstances.

5. Currency

All prices on the Site are in Canadian dollars (CAD) unless otherwise indicated.

6. Payments

Where there’s an error in price or information for any item or service, at our sole discretion, we deserve the right to refuse or cancel your order, even if you have already paid for the order. We have no obligation to sell any product or service, whether online or in person, where the product listed had an incorrect price or information. In the event you have already made payment and we have rejected or cancelled your order, we will refund the amount you had paid for your order, in full.

7. Ordering Products

The Site and the information found on it constitute an “invitation to treat” and is not an offer from us to sell products. When you place an order to purchase a product from us, you are making an offer to buy those products under these terms and conditions. This includes your agreement to fully pay the specified price, along with any applicable shipping and handling fees related to your order. A contract for the sale and purchase of these products will only be established between you and us once we accept your order by sending you a confirmation of acceptance. Confirmations of acceptance do not include “order confirmations”; however, a processing confirmation, shipping preparation, or shipping label confirmation may be considered a confirmation of acceptance.

By submitting an order, you agree that you have thoroughly read and accept all of our policies, including our Shipping and Return Policy.

We reserve the right to verify orders to ensure they are valid. If we suspect fraud, tampering, and/or any violation of any of our terms or policies, we have the right to cancel the order.

Moreover, we reserve the right to limit or refuse any order for any reason, at our sole discretion. This includes limiting or cancelling orders per person, per household, and/or per order. These restrictions may include orders placed under the same account, same credit card, same or similar name, and/or same billing and/or shipping address. We do not allow the practice of “comparison purchasing”, whereby a client orders multiple items with the intent to keep only one while returning the others. We also reserve the right to not ship items to certain addresses or geographical areas. In the event we decide not to accept your order, your order will be refunded.

8. Tax Policy

Taxes charged are based on applicable federal, provincial, and harmonized sales tax rates based on the delivery address of your order. Where required, sales tax will also be applied to shipping and handling charges. In the event of a refund, sales taxes will also be refunded, except on any shipping and handling charges, as those charges are not refundable.

9. Limitation of Liability

In no event shall World Jewellery, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site.

10. Indemnification

You agree to indemnify and hold harmless World Jewellery and its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms and Conditions or your use of the Site.

11. Links to Third-Party Sites

The Site may contain links to third-party Sites or resources. These links are provided for your convenience only and do not imply endorsement by World Jewellery. We have no control over the content or availability of these third-party Sites and are not responsible for any damages or losses arising from your use of them.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflicts of law principles.

13. Severability

If any provision of these terms and conditions are to be found void or unenforceable, the remainder of these terms and conditions shall not be affected.

14. Changes to Terms and Conditions

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of the Site after any such changes constitutes your acceptance of the revised Terms and Conditions.
